Probate is the legal process in which the Supreme Court confirms the validity of a deceased person’s Will. Once granted, it gives the executor legal authority to administer the estate according to the Will’s terms.

Without probate, banks, financial institutions, Refundable Accomondation Deposit (RAD) or the Land Titles Office may not release funds or allow property transfers. Probate provides legal protection for executors and ensures the estate is handled correctly.

Who Can Apply?

If a person dies without a valid Will, Letters of Administration authorise someone to manage and distribute their estate. Depending on the Jurisdiction, the Court prioritises applications based on the deceased’s next of kin.
